I chuckle when an artist foams at the mouth because a politician uses his/her song at an event.
The use implies an endorsement, so I understand it. I hereby grant permission for either party's candidate to use DFTR. Lord knows one of them certainly needs more cowbell.

joe I’m with you, I’m no expert on the matter. However, if the band/singer has signed over their rights, I would presume that was done for financial gain, or a different reason that benefited the artist(s). At this point, I would say it would/should be pretty cut and dry. You no longer have the right, or say so, about this matter. If you want to maintain control over your intellectual property, then do not sell ir. I would be mortified if a political party, that I disagreed with used my song in their campaign, however, if I didn’t maintain my control, then it would just be too bad for me. Especially in the cases where the candidate had done their due diligence, and been given the “all clear” to use it. Just my opinion. Yep, you pretty much nailed it. Some of the scenarios you mentioned are pretty much exactly what happened in some of the cases I read about.
Digression:
Different from the traditional commercial world of artist's copyrights and stuff, but I guess music would be covered? Never ran into that....but I guess if the Government specified to a contractor building a piece of communications equipment that DFTR be played by the gear if "something bad is about to happen", well good luck suing.
The key statement there is (read it carefully):
"(a) Pursuant to 28 U.S.C. 1498, the exclusive remedy for patent or copyright infringement by or on behalf of the Government is a suit for monetary damages against the Government in the Court of Federal Claims. There is no injunctive relief available, and there is no direct cause of action against a contractor that is infringing a patent or copyright with the authorization or consent of the Government (e.g., while performing a contract)."
Yes, there are some conditions and limitations beyond that. We always had to check to make sure the right combination of clauses were included just in case we stumbled and used something we didn't know about.
A Government contract should never be funding a political campaign. If so, I expect there would be bigger problems than copyright infringement.
